1. General provisions
1.1 These Buying and Selling Rules (hereinafter referred to as the “Rules”) set out the mutual rights, obligations and responsibilities of the person purchasing goods in the intimatehome.lt online shop (hereinafter referred to as the “Buyer”) and MB “Mindaugo projektai” (hereinafter referred to as the “Seller”) when the Buyer purchases goods in the online shop. By purchasing goods in the online shop, the Buyer agrees to the application of these Terms and Conditions.
1.2 The Seller reserves the right to change, amend or supplement the Terms and Conditions at any time, taking into account the statutory requirements. The Buyer will be informed of any changes, amendments or additions at the time of logging in to intimatehome.lt and will be required to re-accept the modified Terms and Conditions in order to shop in this online shop.
1.3 The following persons are entitled to make purchases in our online shop:
1.3.1. able-bodied natural persons, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by court order;
1.3.2. minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, except where they are self-reliant;
1.3.3. legal persons;
1.3.4. authorised representatives of all of the above.
1.4 By accepting the Terms and Conditions, the Customer confirms that, in accordance with Clause 1.4 of the Terms and Conditions, he/she has the right to purchase the goods in the intimatehome.lt online shop.
2. Protection of personal data
2.1 The Buyer may order goods from the intimatehome.lt online shop in two ways:
2.1.1. without registration.
2.1.2. with registration:
2.2.When ordering goods both in the ways provided for in Clauses 2.1.1. and 2.1.2. of the Regulations, the Buyer shall specify in the relevant information fields provided by the Seller the personal data necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address.
2.3 If the Buyer agrees, the personal data referred to in Clause 2.2 may be processed by the online shop intimatehome.lt for direct marketing purposes.
2.4 By consenting to the processing of his personal data for the purpose of the sale of goods and services in the Seller’s online shop, the Buyer also consents to the sending of informative messages to the e-mail address and telephone number provided by him, which are necessary for the fulfilment of the order of goods.
2.5 The Seller undertakes not to disclose the Buyer’s personal data to third parties, except for the Seller’s partners who provide delivery or other services related to the proper execution of the Buyer’s order. In all other cases, the Buyer’s personal data may be disclosed to third parties only in accordance with the procedure provided for by the legislation of the Republic of Lithuania.
2.6 The Buyer’s identity document and the Buyer’s data contained therein provided to the Seller’s or the Parcel Delivery Company’s employee shall only be used for the purpose of proper identification of the Buyer.
3. Moment of conclusion of the contract of sale and purchase
3.1 The contract between the Buyer and the Seller shall be deemed to be concluded from the moment the Buyer, having selected the product(s) to be purchased and having formed a shopping cart, clicks on the “Checkout” link.
4. Buyer’s rights
4.1 The Buyer shall have the right to purchase goods in the intimatehome.lt online shop in accordance with these Terms and Conditions.
4.2 The Buyer shall have the right to withdraw from the contract of sale and purchase of goods concluded with the intimatehome.lt online shop by notifying the Seller in writing (by e-mail, indicating the product to be returned, its order number and the reason for the return) not later than within 7 (seven) working days from the date of delivery.
4.3 The Buyer’s right provided for in Clause 4.2 shall be exercised in accordance with the “Rules for the Sale of Goods and the Provision of Services when Contracts are Concluded by Means of Communication”, approved by the Minister of the Economy by means of Order No 258 of 17 August 2001.
4.4 The Buyer may exercise the right provided for in Clause 4.2 only if the goods have not been damaged or substantially altered in appearance or used.
5. Obligations of the Buyer
5.1 The Buyer is obliged to pay the price of the Goods and their delivery, as well as other payments (if any, specified at the time of conclusion of the Contract) and to accept the Goods ordered. The Buyer shall pay for the Goods through the Paysera payment system or by bank transfer.
5.2 If the details provided by the Buyer in the registration form change, the Buyer must update them immediately.
5.3 Once registered, the Buyer undertakes not to disclose his/her login details to third parties.
5.4 The Buyer, when using the intimatehome.lt online shop, undertakes to comply with these Terms and Conditions, other terms and conditions expressly stated in the online shop, and not to violate the legislation of the Republic of Lithuania.
6. Seller’s rights
6.1 If the Buyer attempts to undermine the stability and security of the online shop or violates his/her obligations, the Seller shall have the right to restrict or suspend the Buyer’s access to the online shop or, in exceptional cases, to cancel the Buyer’s registration, immediately and without notice.
6.2 In the event of serious circumstances, the Seller may temporarily or permanently suspend the operation of the Online Shop without prior notice to the Buyer.
6.3 The Seller shall have the right to cancel the Buyer’s order without prior notice to the Buyer if the Buyer, having chosen the method of payment provided for in Clause 8.2 of the Terms and Conditions, fails to pay for the Goods within 3 (three) calendar days.
7. Obligations of the Seller
7.1 The Seller undertakes to enable the Buyer to use the services provided by the intimatehome.lt online shop under the conditions set out in these Terms and Conditions and in the online shop.
7.2 The Seller undertakes to respect the Buyer’s right to privacy with regard to his/her personal information, i.e. to process the personal data provided by the Buyer only in accordance with the procedure set out in Section 2 of the Terms and Conditions and the legislation of the Republic of Lithuania.
7.3 The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer in accordance with the conditions set out in Section 9 of the Terms and Conditions.
7.4 If the Seller, due to important circumstances, is unable to deliver the goods ordered to the Buyer, the Seller undertakes to refund the money paid to the Buyer within 7 (seven) working days, if the prepayment was made.
7.5 If the Buyer exercises the right provided for in Clause 4.2 of the Rules and in the event of the condition provided for in Clause 4.4 of the Rules, the Seller undertakes to refund the Buyer the money paid within 7 (seven) working days from the date of receipt of the returned goods.
8. Prices, payment procedure and terms
8.1 The prices of the Goods in the online shop and in the order form shall be quoted in euros.
8.2 The Buyer shall pay for the Goods using one of the following methods:
8.2.1. electronic banking through the Paysera.lt system or the methods specified in the Paysera system;
8.2.2. by bank transfer;
8.3. if the Buyer chooses the method of payment by electronic banking through the Paysera.lt system, the Buyer undertakes to pay immediately. Only upon receipt of payment for the goods shall the parcel of goods begin to be formed and the delivery period begin to run.
9. Delivery of goods
9.1 Delivery of Goods to the Buyer:
9.2 The Goods shall be delivered to the specified shipping terminal:
9.2.1 The Buyer undertakes to specify the shipping terminal at which it wishes to receive the Goods.
9.2.2. the shipment shall be held at the parcel terminal for 72 hours (LP EXPRESS), 168 hours (OMNIVA). At the end of the period, the consignment shall be returned to the sender.
9.2.3.
9.3 Delivery of the Goods to the address specified by the Buyer:
9.3.1.
9.3.2 The Buyer undertakes to collect the goods himself. In the event that the Buyer is unable to take delivery of the goods himself and the goods are delivered to the address indicated and on the basis of other data provided by the Buyer, the Buyer shall not have the right to claim against the Seller for the delivery of the goods to the wrong entity.
9.3.3 The goods shall be delivered by the Seller or its authorised representative.
9.4 The delivery/transportation charge shall be based on the size of the goods or the amount of the order.
9.5 The Buyer agrees that in exceptional circumstances the delivery of the Goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In such event, the Seller undertakes to contact the Buyer immediately to agree the terms of delivery.
9.6 In all cases, the Seller shall be exempt from liability for breach of the time limits for delivery of the Goods if the Goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Buyer’s control.
9.7 At the time of delivery of the Goods to the Buyer, the Buyer shall inspect the condition of the consignment and of the Good(s) together with the Seller or its authorised representative and sign the consignment handover/acceptance document. Once the Buyer has signed the handover/acceptance document, the consignment shall be deemed to have been handed over in good condition, and there shall be no damage to the goods attributable to defects other than manufacturing defects and no inconsistencies in the assembly of the goods (such as can be detected by an external inspection of the goods). If the Buyer notices that the packaging of the delivered consignment is damaged (crumpled, wet or otherwise externally damaged), that the item(s) are damaged and/or that the item(s) are not in the right condition, the Buyer shall note this in the handover/acceptance document of the consignment, and shall draw up a free-form certificate of the damage/mismatch of the consignment and/or the item(s), in the presence of the Seller or his representative. If the Buyer fails to do so, the Seller shall be exempt from liability to the Buyer in respect of any damage to the goods, provided that such damage is not due to a manufacturing defect, and in respect of any inconsistencies in the assembly of the goods, provided that such inconsistencies can be detected by an external inspection of the goods.
10. Return and replacement of goods
10.1.Defects in the goods sold shall be eliminated, defective goods shall be replaced and returned in accordance with the “Rules of Retail Trade” approved by the Government of the Republic of Lithuania by Resolution No. 697 of 11 June 2001.
10.2 In order to return the product(s), the Buyer must fill in a return request form and send it to info@intimatehome.lt
10.3 The Buyer may exercise the right provided for in Clause 10.1 within 7 (seven) calendar days from the date of delivery of the Goods to him by informing the Seller in accordance with the procedure provided for in Clause 10.2 of the Rules.
10.4 The Buyer must comply with the following conditions when returning the Goods:
10.4.1. the returned goods must be in their original packaging in good condition (this clause does not apply in the case of the return of low-quality goods);
10.4.2. the goods must be undamaged by the Buyer;
10.4.3. the goods must not have been used and must not have lost their merchantable appearance (this clause does not apply in the case of a return of low quality goods);
10.4.4. the returned goods must be in the same condition as when received by the Buyer;
10.5. the Seller shall have the right not to accept the Buyer’s returns if the Buyer fails to comply with the return procedure set out in this Article.
10.6. Goods of inadequate quality or quality goods which the Buyer does not like the shape, size, colour, model or completeness shall be replaced or returned in accordance with the Retail Trade Rules approved by the Government of the Republic of Lithuania by Resolution of the Government of the Republic of Lithuania No. 697 of 11 June 2001, the Civil Code of the Republic of Lithuania and other applicable legislation of the Republic of Lithuania.
10.7 In all cases, money for returned goods shall be transferred by payment order and only to the payer’s bank account.
11. Responsibility
11.1 The Buyer is fully responsible for the accuracy of the personal data provided by him. If the Buyer fails to provide accurate personal data, the Seller shall not be liable for the consequences arising therefrom and shall be entitled to claim direct damages from the Buyer.
11.2 The Buyer shall be liable for the actions carried out using this online shop.
11.3 Once registered, the Buyer is responsible for the transmission of his/her login data to third parties. If a third party uses the services provided by intimatehome.lt by logging in to the online shop using the Buyer’s login data, the Seller shall consider this person as the Buyer.
11.4 The Seller shall be exempt from any liability in cases where the loss is caused by the Buyer’s failure to read these Terms and Conditions, notwithstanding the Seller’s recommendations and obligations, even though the Buyer was given the opportunity to do so.
11.5 In the event of damage, the party at fault shall indemnify the other party against direct damages.
11.6 The Seller shall not be liable for the proper performance of obligations between the Buyer and the Seller’s partners whose services the Buyer orders.
12. Marketing measures by the Seller
12.1 The Seller may, at its sole discretion, initiate various promotions on the intimatehome.lt online shop.
12.2 The Seller reserves the right, at its sole discretion, to introduce and/or withdraw offers, promotions or change the prices of the Goods at any time, without prejudice to the rights of the Customer, including the terms of the Contract.
12.3 Discounts shall not be aggregated.
13. Exchange of information
13.1 The Seller shall send all notices in accordance with the procedure set out in Clause 2.2 of the Terms and Conditions to the email address provided by the Customer.
13.2 The Buyer shall send all notices and questions to the email address info@intimatehome.lt
14. Use of cookies
14.1 In order to offer the Buyer or a visitor to the Online Shop the full range of services offered in the Online Shop, the Administrator uses system cookies. Cookies are used to identify a previous visitor to the Online Shop, to determine the language of the Online Shop page, to identify the user’s session and session key, as well as to identify and correct errors in the Online Shop.
15. Final provisions
15.1 These Rules are made in accordance with the legislation of the Republic of Lithuania.
15.2 The relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.
15.3 All disagreements arising from the execution of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
